APPLICATION UNDER SECTION 125 OF Cr.P.C. FOR GRANT OF MAINTENANCE

THE APPLICANT MOST RESPECTFULLY STATES AS FOLLOWS:

  1. That the Applicant is the legally wedded wife of the Respondent. The marriage between the Applicant and the Respondent was solemnized on [Date] as per Hindu customs and rites at [Place].

  2. That after the marriage, the Applicant started residing with the Respondent at their matrimonial home and discharged all her marital duties with sincerity and dedication.

  3. That the Applicant is a housewife, aged about 49 years, having no independent source of income, and is completely dependent on the Respondent for her sustenance.

  4. That the Respondent is a Government servant employed as an Indian Engineering Services (IES) Officer and is presently posted at Mumbai, earning a handsome monthly salary of over ₹1,25,000/- (approx.), besides other government allowances and benefits.

  5. That for the past [mention duration, e.g., 2 years], the Respondent has deserted the Applicant without any just cause or justification, and is neither living with her nor maintaining her in any manner.

  6. That repeated attempts for reconciliation and requests for financial support by the Applicant were ignored and even responded to with cruelty and indifference by the Respondent.

  7. That the Applicant is living in a state of financial hardship and is unable to meet her basic necessities such as food, clothing, shelter, and medical expenses, due to the Respondent's neglect and refusal to maintain her.

  8. That under Section 125 of the Cr.P.C., every person having sufficient means is legally bound to maintain his wife, if she is unable to maintain herself, and the Respondent has grossly failed in fulfilling his legal and moral obligations.

PRAYER

In view of the above facts and circumstances, the Applicant most respectfully prays that this Hon’ble Court may be pleased to:

  1. Direct the Respondent to pay a monthly maintenance of ₹25,000/- (Rupees Twenty-Five Thousand Only) or any other amount deemed just and proper by this Hon’ble Court;

  2. Award the cost of this application to the Applicant;

  3. Pass such other order(s) as this Hon’ble Court may deem fit, just, and proper in the interest of justice.

AND FOR THIS ACT OF KINDNESS, THE APPLICANT AS IN DUTY BOUND SHALL EVER PRAY.
