वेश्यावृत्ति से उत्पन्न बच्चों का अधिकार गौरव जैन बनाम UOI : AIBE 20 विशेषांक

 गौरव जैन बनाम यूनियन ऑफ इंडिया (Gaurav Jain v. Union of India) एक सुप्रीम कोर्ट का महत्वपूर्ण मामला है, जिसमें वेश्याओं के बच्चों और बाल वेश्याओं के अधिकारों और पुनर्वास को लेकर पीआईएल (जनहित याचिका) दायर की गई थी। इस केस में सुप्रीम कोर्ट ने कहा कि वेश्याओं के बच्चे भी समाज के मुख्य धारा का हिस्सा हैं और उन्हें बिना किसी कलंक के सामाजिक जीवन में समान अवसर, गरिमा, देखभाल, और संरक्षण का अधिकार है।

कोर्ट ने स्पष्ट किया कि वेश्याओं के बच्चों को उनकी पहचान और उत्पत्ति के कारण अलग-थलग नहीं किया जाना चाहिए। इसके बजाय, उनका पुनर्वास और बेहतर जीवन सुनिश्चित करने के लिए विशेष योजनाएं बनानी चाहिए। कोर्ट ने मामले में एक समिति गठित करने और पुनर्वास तथा सामाजिक समावेशन के लिए नियमित रिपोर्ट प्रस्तुत करने का निर्देश दिया।

यह मामला 1997 में सुप्रीम कोर्ट में सुनवाई हुआ था, और इस निर्णयन से वेश्याओं के बच्चों को समाज में समान दर्जा मिलने में महत्वपूर्ण भूमिका निभाई गई। न्यायालय ने इस मुद्दे पर गहरी संवेदनशीलता दिखाते हुए कहा कि समाज जिम्मेदार है कि वह ऐसे बच्चों को सामाजिक बहिष्कार से बचाए और उनका पुनर्वास सुनिश्चित करे। संक्षेप में, गौरव जैन बनाम यूओआई ने वेश्याओं के बच्चों के मानवाधिकारों को मान्यता दी और उन्हें सामाजिक न्याय और पुनर्वास की दिशा में कानूनी संरक्षण प्रदान किया
